Temporary Extension of Outside Dining

REGISTRATION & APPLICATION PROCESS

The Town of Fuquay-Varina has developed a Temporary Extension of Outdoor Dining/Seating Guidelines to assist food and beverage service providers during the State of North Carolina Phase 2 - easing of restrictions. The Governor’s Executive Order 141 limits on-premise indoor dining/seating to either 50% of the stated fire capacity of the business or no more than 12 customers per 1,000 SF of the total square footage of the location, whichever is lower.

Fuquay-Varina Mayor John W. Byrne states, “Our food and service businesses are important to the livelihood of our community. Our reopening of restaurants and other permitted food and beverage businesses represents a major step for our community during these unprecedented times. By allowing the temporary expansion of outdoor dining/seating for food and beverage businesses that are allowed to be open, our businesses will hopefully have a chance to better recover from the impacts of the pandemic. Town staff will be working closely with our businesses to ensure all guidelines are followed that keep both employees and customers safe as we adjust to the new normal.”

The guidelines allow for restaurants and other permitted food and beverage businesses to utilize private parking spaces and sidewalks for temporary outdoor dining conversion. Food and beverage businesses with dedicated parking may convert up to 25% of parking spaces to temporary outdoor dining. This can allow for more dining capacity while complying with the Town of Fuquay-Varina Outdoor Dining/Seating Ordinance and Governor Cooper’s phase 2 requirements.

Any food and beverage business that wishes to establish new temporary outdoor dining areas in order to operate consistent with the State of North Carolina Phase 2 – Easing Restrictions must comply with the following applicable State and local laws, ordinances, including but not limited to the North Carolina Building Code and the North Carolina ABC Commission.

All food and beverage business are required to register temporary outdoor dining/seating with the Town of Fuquay-Varina and comply with the requirements outlined in the Temporary Outdoor Dining/Seating Guidelines.
